GTE Engineering operates this store and website, including all related information, content, features, tools, products, and services to provide you with a curated shopping experience (the “Services”). GTE Engineering is powered by Shopify Inc. (“Shopify”), which enables us to provide the Services.

The terms and conditions below, together with any referenced policies (collectively, these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

AI‑Assisted Communications & Content Disclosure

Use of Artificial Intelligence (“AI”)

GTE Engineering LLC may use artificial intelligence–assisted tools and technologies to support the creation, refinement, editing, translation, spelling, and grammar of communications, marketing content, and publicly accessible materials on our website, social media platforms, forums, and other online presences.

All such content is reviewed, approved, and published under the oversight of GTE Engineering LLC personnel. Use of AI is solely for assistance and efficiency purposes and does not replace human judgment, expertise, or decision‑making. GTE Engineering LLC remains fully responsible for the accuracy, substance, intent, and compliance of all communications and content provided to customers and site visitors.

AI‑assisted tools do not provide technical advice, diagnostics, engineering determinations, legal advice, or representations of any kind.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence and that you have legal capacity to enter into these Terms. If you permit any minor dependents to use the Services on devices you own or manage, you are responsible for their activity.

To use the Services, including browsing our online store or purchasing products or services, you may be required to provide information such as your name, email address, billing details, payment information, and shipping address. You represent and warrant that all information you provide is accurate, current, complete, and that you have the right to provide such information.

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account. You may not transfer, sell, assign, or license your account to any other person or entity.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to accurately describe and display our products and services. However, product images, colors, and appearances may vary depending on device settings, lighting, or display technology. We do not guarantee that products or services will meet your expectations or exactly match online depictions.

All product descriptions, specifications, pricing, and availability are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product or limit quantities offered to any person, geographic region, or jurisdiction.

SECTION 3 – ORDERS & WARRANTY

Order Acceptance

When you place an order, you are making an offer to purchase products or services. GTE Engineering LLC reserves the right to accept, reject, limit, or cancel any order at its discretion. An order is not accepted until confirmed by us and payment has been received and processed.

Please review your order carefully before submitting. Cancellation requests may not be accommodated after order acceptance. If we modify or cancel an order, we will attempt to notify you using the contact information provided at checkout.

Rebuilt Parts & Warranty

Rebuilt parts are final sale, except where expressly approved in writing by GTE Engineering LLC. Due to the nature of rebuild services, parts and labor cannot be reversed once work has commenced.

Warranty coverage for parts manufactured or rebuilt by GTE Engineering LLC or PEGA Clutch™ (“Warranty”) is governed by our Warranty Page: https://gte-engineering.com/pages/warranty.

Coverage includes:

Clutch & Non-Oil Driven Parts:
Free from workmanship and rebuild-related material defects for one (1) year from original delivery.

Oil-Driven Parts (PTUs, transmissions, hydraulics):
Warranty coverage for workmanship and rebuild materials for ninety (90) days from delivery.

Labor Coverage:
Labor related to removal, reinstallation, and testing is covered only when installation is performed by GTE Engineering’s workshop. Labor warranty does not apply to third-party installations.

Conditions

Warranty applies only if all conditions on our Warranty Page are met, including:

Proper installation by a licensed, qualified, and certified automotive repair facility.

Compliance with OEM and GTE Engineering installation, diagnostic, adaptation, and break-in procedures.

Required documentation (proof of purchase, installation invoice, diagnostic evidence).

Warranty void if installed by DIY or non-certified individuals, or if the vehicle is modified, abused, or improperly maintained.

Exclusions

Warranty does not cover:

Normal wear (friction materials, consumables)

Improper installation, abuse, neglect, contamination, accident, collision, or lack of maintenance

Failures due to unrelated systems (electrical faults, sensors, etc.)

Modified, tuned, or track-only vehicles, including altered ECU, suspension, drivetrain, or exhaust

Third-party parts not originally manufactured or rebuilt by GTE Engineering or PEGA Clutch™

Claims Procedure

All warranty claims require return of the part or sufficient evidence for inspection. Parts must be returned at the claimant’s expense unless otherwise instructed. Warranty inspections may take up to three (3) months.

Liability Exclusions

Under no circumstances shall GTE Engineering LLC be responsible or liable for incidental, special, consequential, indirect, or punitive damages, loss of use, diminished value, rental costs, or vehicle downtime beyond the express warranty remedies.

SECTION 4 – PRICES AND BILLING

Prices, discounts, promotions, and availability are subject to change without notice. The price charged will be the price in effect at the time the order is placed and confirmed. Unless expressly stated, prices do not include taxes, shipping, handling, customs, or import charges.

You agree to provide current, complete, and accurate billing, payment, and account information. You authorize us to charge your selected payment method for all amounts due, including applicable taxes and fees.

SECTION 5 – SHIPPING AND DELIVERY

Delivery dates and transit times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs authorities, weather, labor disputes, or events beyond our reasonable control. Title and risk of loss pass to you upon transfer of the product to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services, including text, graphics, logos, images, videos, audio, designs, and software, is owned by or licensed to GTE Engineering LLC and is protected by U.S. and international intellectual property laws. These Terms grant you a limited, non‑exclusive, non‑transferable license for personal, non‑commercial use only.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third‑party tools or services that we do not control or monitor. Such tools are provided “as is” and “as available” without warranties of any kind. Your use of optional third‑party tools is entirely at your own risk.

SECTION 8 – THIRD‑PARTY LINKS

The Services may contain links to third‑party websites. We are not responsible for the content, accuracy, or practices of third‑party sites. Accessing third‑party websites is done at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

GTE Engineering LLC is powered by Shopify; however, all sales and transactions are solely between you and GTE Engineering LLC. Shopify is not responsible for any aspect of the transactions, products, or services. You expressly release Shopify from any claims related to purchases made through the Services.

SECTION 10 – PRIVACY POLICY

Your use of the Services is subject to our Privacy Policy and Shopify’s Privacy Policy. Information may be processed and stored outside your jurisdiction. Please review the Privacy Policy for details on data collection and use.

SECTION 11 – FEEDBACK

If you submit feedback, reviews, testimonials, or suggestions, you grant GTE Engineering LLC a perpetual, irrevocable, worldwide, royalty‑free, sublicensable license to use such content for any purpose, including marketing and promotional use.

SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS

We reserve the right to correct errors, inaccuracies, or omissions and to change or cancel orders if information is inaccurate, at any time without prior notice.

SECTION 13 – PROHIBITED USES

You agree not to misuse the Services, violate laws or regulations, infringe intellectual property, transmit malicious code, engage in harassment or abuse, or interfere with security features. We reserve the right to suspend or terminate access for violations.

We may terminate or suspend access to the Services at any time without notice. Obligations incurred prior to termination shall survive.

To the fullest extent permitted by law, GTE Engineering LLC and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services or products, even if advised of the possibility.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless GTE Engineering LLC, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, damages, liabilities, losses, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, violation of law, or use of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to enforce any provision shall not constitute a waiver. These Terms constitute the entire agreement between you and GTE Engineering LLC and supersede all prior agreements or communications.

SECTION 20 – ASSIGNMENT

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

SECTION 21 – GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict‑of‑law principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in New Jersey.

SECTION 22 – HEADINGS

Headings are for convenience only and do not affect interpretation.

SECTION 23 – CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time by posting changes on this page. Continued use of the Services constitutes acceptance of the revised Terms.
